Procedural Posture
Criminal Revision / Ruling on Application for Sentence Revision
Legal Issues
- 1 Whether the applicant's sentence should be revised in light of the presentence report and his conduct.
- 2 Whether the applicant poses a security threat to his family warranting denial of sentence revision.
Ratio Decidendi
The court declined to revise the applicant's sentence because the presentence report established that he is a serious security threat to his family, having threatened to kill close relatives who have consequently fled their home. The court found no justification to interfere with the sentence imposed by the trial court, emphasizing the need to protect the applicant's family and the public from further harm. The applicant's guilty plea and the gravity of his conduct, as evidenced by the threats, outweighed any mitigating factors that might have warranted sentence revision.
Court Disposition
Application for sentence revision declined.
Orders
- Sentence remains as imposed by the trial court.
- File closed.

Ruling
1. The offender / convict is Brian Otieno Otieno. He was sentenced to serve 3 years imprisonment on October 5, 2022 for the offence of breaking into a building (school) and stealing a laptop from therein. He pleaded guilty to the charge. However, the presentence report filed by the probation officer shows that the convict is a serious threat to his own family members whom he has threatened to kill including his grandmother and mother who have been forced to seek refuse away from home.
2. I decline to revise his sentence as the convict is a serious security threat to the family.
3. File closed.
