Ratio Decidendi

The court held that the sentence of twenty years' imprisonment imposed on the appellant for defilement under Section 8(3) of the Sexual Offences Act was lawful, as it is the statutory minimum for the offence. The trial court had no discretion to impose a lesser sentence. However, the court found that the trial magistrate erred by not considering the period the appellant spent in custody prior to sentencing, as required by Section 333(2) of the Criminal Procedure Code. The court therefore ordered that the sentence should run from the date of arrest, 2 January 2021, thereby partially allowing the appeal on sentence.
