The applicant's omission of this fact was found to be an attempt to mislead the court and amounted to an abuse of process. The court further found that the sentence imposed was lawful and lenient given the gravity of the injuries suffered by the complainant, who was a minor and sustained life-altering harm. The only recourse available to the applicant, if aggrieved, was to appeal to the Court of Appeal. Accordingly, the application for review was dismissed for lack of merit.
