Ratio Decidendi

The court found that the claimant was employed on probation from February 25, 2014, at a salary of Kshs. 55,000 per month. The respondent's unilateral reduction of salary was not justified. The contract was terminated during probation, and the applicable law required only 7 days’ notice or pay in lieu. The claimant had not served for 12 months, so pro-rata leave and service gratuity were not due. The court awarded the claimant 7 days’ wages in lieu of notice and unpaid salary for April 2014, but not the other claims. Due to misleading pleadings regarding the period of employment, the respondent was ordered to pay only 50% of the claimant’s costs.
