The court found that the second Plaintiff could not be properly joined as a plaintiff without written authority as required by Order 1, Rule 13(2) of the Civil Procedure Rules, and such authority was not filed. The first Plaintiff, being a non-Kenyan citizen, was barred by Article 65(1) of the Constitution from owning freehold land in Kenya. Consequently, the first Plaintiff lacked locus standi to institute the suit, as he did not have the legal capacity to own the suit land under freehold tenure, nor did he own it jointly with a Kenyan citizen at the material time.
