Although the application was made without unreasonable delay, the applicant did not offer any security for the due performance of the decree, nor did he address repayment of the outstanding loan to the second defendant in the event of losing the appeal. Since the three conditions for granting a stay are conjunctive and not all were satisfied, the application for stay of execution pending appeal was dismissed with costs.
