The court found that the claimant's suit was based on a contract of service and the computation of gratuity, which falls squarely within the Employment Act. Section 89 of the Employment Act requires such claims to be filed within three years from the date the cause of action arose. The claimant became aware of the computation of his gratuity on 16th July 2015 but did not file suit until 30th August 2024, a delay of approximately nine years. The court held that this delay was inordinate and not justified by the claimant's explanation of lack of funds, especially as mechanisms exist for exemption from legal fees.
