Ratio Decidendi

The court found that the consent order of October 25, 2022, expressly required the memorandum of appeal to be filed within 14 days, lapsing on November 7, 2022. The memorandum of appeal was filed on November 22, 2022, outside the permitted period, and there was no evidence that the appellant sought or obtained an extension or further leave to file out of time. Guided by binding Court of Appeal decisions, the court held that filing an appeal out of time without leave goes to the jurisdiction of the court and renders the appeal incompetent. The court therefore allowed the application and struck out the memorandum of appeal as filed out of time, awarding costs to the respondent.
