Although the court has discretion to allow amendments at any stage of proceedings, including after close of pleadings, such discretion is not absolute. The proposed amendments in the draft amended petition would fundamentally alter the character of the suit, introducing several new paragraphs and substantially different reliefs. The issues raised in the amended draft are more appropriately tried under a normal claim or cause rather than a constitutional petition. Allowing the amendment would change the action into one of a substantially different character, which could more conveniently be made the subject of a fresh action. Therefore, the application for leave to amend is dismissed.
