The High Court found that the sentence of a fine of Kshs 50,000,000 or 12 months imprisonment was manifestly excessive and disproportionate given the applicant's status as a first offender, his inability to pay such a fine, the low value of the narcotic drugs involved (Kshs 12,000), and the positive presentence report recommending a non-custodial sentence.
