Legal Issues
- 1 Whether the applicant is entitled to a review of his sentence for possession of narcotics.
- 2 Whether the existence of a pending robbery with violence case affects the court's discretion to review the sentence.
Ratio Decidendi
The court declined to exercise its discretion to review the applicant's sentence for possession of narcotics because there was a pending robbery with violence case against him, the outcome of which was unknown. The existence of unresolved criminal proceedings was deemed a sufficient reason to withhold sentence review, as it could impact the interests of justice. The sentence imposed was found to be lawful, and no exceptional circumstances were demonstrated to warrant interference by the court. Accordingly, the application for sentence review was dismissed and the file closed.

(From the original conviction and sentence in Kisumu Chief Magistrate’s Court Criminal Case No. E120 of 2023)
Ruling
1. The convict Richard Ouma Ouma was sentenced to serve one and a half years for the offence of being found in possession of narcotics contrary to section 3(1) as read with section 3(2) of the Narcotic Drugs and Psychotropic Substances Control Act on 31st October, 2023. He has been in jail since then and now served one year and two months imprisonment.
2. He however had a pending robbery with violence case being Kisumu CM Cr. Case No. E780 of 2022.
3. For the above reason that the fate of the robbery with violence case against him is not known, I decline to exercise any discretion on the lawful sentence imposed.
4. The request for sentence review is declined and dismissed.
