Legal Issues
- 1 Whether the sentence imposed on the applicant for possession of alcoholic drinks was appropriate in the circumstances.
- 2 Whether a non-custodial sentence should be substituted for the custodial sentence imposed by the trial court.
Ratio Decidendi
The court found that, considering the applicant's plea of guilty, the time already served in custody, and the positive recommendation in the Sentence Review Report, a non-custodial sentence was appropriate. The court exercised its revisionary jurisdiction to substitute the remaining custodial sentence with a community service order, ensuring the punishment remained proportionate and rehabilitative rather than purely punitive.
Court Disposition
sentence revised; custodial sentence substituted with community service order
Orders
- The applicant shall serve a community service order at Gachuba Chief’s Officer under the supervision of Mr Thomas Ondieki for the remaining part of the sentence being 2 months and 3 weeks.
