Procedural Posture

Constitutional Petition / Ruling on Preliminary Objection and Interlocutory Application

  1. 1 Whether the High Court has jurisdiction to enforce a decree issued by the Employment and Labour Relations Court.
  2. 2 Whether the application for injunction is merited given the events that have already occurred.
  3. 3 Whether the petition is properly before the High Court or should have been filed in the Employment and Labour Relations Court.

Ratio Decidendi

The High Court lacks jurisdiction to enforce decrees or judgments issued by the Employment and Labour Relations Court, as both are courts of equal status with distinct constitutional and statutory mandates. The applicant's attempt to enforce the ELRC's decree through a constitutional petition in the High Court is impermissible. Jurisdiction is foundational and cannot be conferred by consent or by the court itself; it is strictly determined by the Constitution and statute. Since the reliefs sought are grounded on the ELRC's judgment, the proper forum for enforcement is the ELRC itself. The application for injunction is also moot as the events in question have already occurred....
