Procedural Posture

Criminal Appeal / Judgment on Appeal Against Sentence

  1. 1 Whether the trial court erred in sentencing the appellants without adequate consideration of their mitigation as first offenders and their personal circumstances.
  2. 2 Whether the trial court failed to account for the period the appellants spent in remand custody as required by section 333(2) of the Criminal Procedure Code.
  3. 3 Whether the sentences imposed were manifestly excessive or improper in the circumstances.

Ratio Decidendi

The High Court found that the trial court had properly exercised its sentencing discretion, taking into account the appellants' mitigation, their status as first offenders, and the seriousness of the offences. The sentences imposed were considered lenient relative to the statutory maximums. However, the trial court failed to specify that the sentences should account for the period spent in remand custody as required by section 333(2) of the Criminal Procedure Code. The appellate court therefore upheld the convictions and sentences but ordered that the sentences run from the date of arrest, February 15, 2021, to comply with statutory requirements regarding remand credit.

Court Disposition

Appeal against conviction dismissed; sentences upheld with modification to account for remand period.

Orders

  • Appeal against conviction is dismissed.
  • Sentences imposed by the trial court are upheld.
