Legal Issues
- 1 Whether the sentence review application is moot given that the applicant has already served the full term of imprisonment.
- 2 Whether any further orders are necessary in light of the applicant's completed sentence.
Ratio Decidendi
The court found that since the applicant, Kennedy Owino, had already served the entire two-month imprisonment imposed for wilfully obstructing the free passage of persons or vehicles, the application for sentence review was overtaken by events. There was no longer any live issue for the court to determine, and as such, the file was ordered closed. The court emphasized that judicial resources should not be expended on academic or moot questions where the substantive sentence has already been completed.
Court Disposition
Application for sentence review declared moot and file closed.
Orders
- The Sentence Review Report dated 24th August 2023 is overtaken by events.
- The file is closed.
