Procedural Posture

Environment and Land Appeal / Ruling on Application to Dismiss Appeal for Late Filing of Record

  1. 1 Whether the appellants filed the record of appeal within the time granted by the court.
  2. 2 Whether the period between 21 December and 13 January should be excluded from the computation of time under Order 50 Rule 4.
  3. 3 Whether the appeal stood dismissed for failure to file the record of appeal within the stipulated period.

Ratio Decidendi

The court held that, although the appellants were granted 45 days from 16 November 2023 to file and serve the record of appeal, Order 50 Rule 4 of the Civil Procedure Rules expressly excludes the period between 21 December and 13 January from the computation of time. Upon recalculating the deadline with this exclusion, the court determined that the final day for filing was 24 January 2024. The record of appeal was filed on 19 January 2024, which was within the permissible period. Therefore, the application to dismiss the appeal for late filing was without merit and was dismissed with costs to the appellants.
