The court found that the Respondent satisfied the requirements for a stay of execution pending appeal, as there was a risk of substantial loss if the Petitioner executed the judgment and no evidence was provided that the Petitioner could refund the sum if the appeal succeeded. The application for stay was filed without unreasonable delay. On the review application, the court determined that the order of 26th September 2022 compelling payment of gratuity and salary shortfall was made in error, as the judgment did not award gratuity and there was no consensus or uncontested admission regarding the salary shortfall.
