The applicant had lodged a Notice of Appeal, satisfying the procedural requirement for seeking stay. The court was satisfied that the applicant had met the threshold for grant of stay of execution pending appeal, subject to provision of security. The court therefore allowed the application for stay of execution of the costs order, conditional upon the applicant depositing Kshs 200,000 as security in a joint interest-earning account within 45 days, failing which the stay would lapse. Each party was ordered to bear their own costs of the application.
