The High Court found that although there was no documentary evidence of the deceased's monthly earnings, the trial magistrate's use of a Kshs. 7,000 multiplicand was reasonable in the circumstances, given the deceased's occupation as a boda-boda rider and the guidance from Jacob Ayiga Maruja & another v Simeon Obayo. The court agreed with the trial magistrate's choice of a 30-year multiplier but identified an error in the application of the dependency ratio. Since the deceased was unmarried and childless, a dependency ratio of one-third was appropriate, not two-thirds as used by the trial court. The correct calculation should have been 30x12x7000x1/3, resulting in Kshs. 840,000, less 30%...
