Ratio Decidendi

The court found that the application for stay of execution was filed within a reasonable time, less than two months after judgment. The court determined that the applicant could suffer substantial loss if the entire decretal sum is paid out and the appeal later succeeds, as recovery may be difficult. However, the court held that stay of execution is justified only if the applicant pays part of the decretal amount as security. The court ordered the applicant to pay Kshs 80,000 to the respondent within 45 days as sufficient security, failing which the stay would lapse. The costs of the application were ordered to abide the outcome of the appeal.
