Legal Issues
- 1 Whether the applicant's sentence for assault causing actual bodily harm should be revised in light of his plea for leniency and criminal record.
Ratio Decidendi
The court declined to revise the applicant's sentence of two years imprisonment for assault causing actual bodily harm, finding that the applicant was a repeat offender with a recent prior conviction and sentence for a similar offence. The court determined that the sentence imposed by the trial court was neither illegal nor manifestly excessive, and that the applicant's criminal history and recidivist tendencies justified the sentence. The plea for leniency was outweighed by the need to deter repeat offending and protect the public. Accordingly, the application for sentence revision was dismissed and the original sentence upheld.
Court Disposition
Application for sentence revision dismissed; original sentence upheld.
Orders
- Sentence not revised; applicant to serve two years imprisonment as imposed by the trial court.
