The Plaintiffs, being wife and son of the 2nd Defendant, were not parties to the sale agreement and could not claim damages for its breach. However, the suit land, being matrimonial property, is subject to the 1st Plaintiff's spousal rights under section 28(a) of the Land Registration Act.
