The court found that there was a genuine dispute as to whether the taxed costs in Nairobi H.C. Misc. Application No. 332 of 2012 had been settled by payments made in Nairobi H.C. Misc. Application No. 368 of 2011 and by other payments, some of which were not factored into the calculations of the outstanding fees. The court held that it would be unjust to allow execution and sale of the attached motor vehicle to proceed before the parties had taken proper accounts to determine the true amount, if any, outstanding.
