This error was attributed to the parties' counsels interchangeably referring to their clients as applicants and respondents in their submissions, leading to confusion. Upon review, and with all parties in agreement, the court held that the correct party liable for the auctioneer's charges arising from the execution in Milimani HCCC No. 535 of 2005 is Nairobi Institute of Business Studies Ltd. The court exercised its power of review to correct the error on the face of the record and clarified that the auctioneer's costs should be taxed...
