The court found that the estate of the deceased should be distributed equally among his four children, in accordance with Section 38 of the Law of Succession Act. Since one of the children was deceased, his share devolved to his only child, a minor, as per Section 41. The central dispute was the appointment of a trustee for the minor's share. The court held that, under Rule 32(1) of the Probate and Administration Rules, the surviving parent is the preferred trustee unless there is evidence of incapacity, which was not alleged or proven.
