The court found that its earlier ruling dismissing the originating summons was made without considering the applicant's written submissions, which had in fact been filed and served. Upon review, the court determined that the applicant had provided a satisfactory explanation for the delay in filing the originating summons, namely that she only became aware of the respondent's alleged negligence in 2020 and acted promptly thereafter, and that the delay was also attributable to ongoing medical treatment for the minor and the time taken by the Medical Practitioners and Dentists Board to determine her complaint.
