Ratio Decidendi

The court found that the applicant failed to provide evidence that the respondent was a man of straw, but also noted that the respondent did not provide evidence of means. In the absence of clear evidence on the respondent's financial capacity, and considering the risk that the decretal sum may not be refunded if the appeal succeeds, the court held it probable that the applicant may suffer substantial loss. The court further held that the appropriate security for due performance of the decree is the full decretal sum of Kshs 2,000,000, not the partial amount offered by the applicant.
