Upon Monica's death, her interest passed to John Charles Odinga by right of survivorship, and the property did not form part of her estate to be disposed of by will. The three children of John Charles Odinga and Pamela Akinyi Awuor, who are orphans, currently reside on the property and rely on the rental income for their education and upkeep. Granting the orders sought by the second and third defendants would deprive the children of essential support and would not be just or equitable, especially as the substantive ownership dispute remains unresolved....
