The court found that the respondent's summary dismissal of the claimant was both substantively and procedurally unfair. The claimant was on authorized study leave, which had been extended, and her absence was not without lawful cause. The respondent acted irrationally and failed to provide the claimant with a reasonable opportunity to respond to the show cause letter, nor did it facilitate a fair hearing. The respondent's reliance on Section 44(4)(a) of the Employment Act was misplaced, as the claimant's absence was justified by her ongoing studies and lack of an air ticket. Orders

  • In the alternative, the respondent shall pay the claimant 1 month salary in lieu of notice at Kshs. 54,592 and 12 months’ salary in compensation at Kshs. 655,104, totaling Kshs. 709,696.
