The sum of Kshs. 3,636,993.24 claimed by the applicant was unsupported and exceeded the jurisdiction of the Small Claims Court. The application for stay was made promptly, but the absence of demonstrated substantial loss meant the core requirement for granting stay was not met. Consequently, the court dismissed the application for stay of execution pending appeal.
