Ratio Decidendi

The Defendant's proposal to sell Villa No. 7 and Villa No. 8, which are not registered in his name, does not bind the Plaintiff or the court. The Plaintiff is entitled to proceed with attachment and sale of the Defendant's shares as per the warrants of attachment already issued. The Defendant has not demonstrated any illegality or procedural impropriety in the Plaintiff's chosen mode of execution. Therefore, the Defendant's application seeking court-sanctioned valuation and sale of the villas is dismissed.
