The court found that although the plaintiff's claim was based on contract and would ordinarily be statute barred under Section 4(1) of the Limitation of Actions Act, the evidence of part payment and acknowledgment of debt by the defendants in 2014 revived the cause of action under Section 23(3). The court further held that the proper party to be sued is the statutory body corporate established under the Pyrethrum Act No. 22 of 2013, which inherited the liabilities of the former entity.
