The Tribunal found that the landlord's calculation of rent arrears, which relied on a 20% increment policy, was not supported by law or Tribunal authority. Under Cap. 301, any increase in rent for a controlled tenancy must be sanctioned by the Tribunal, and the only lawful increment was the one ordered on September 24, 2021, effective January 1, 2020. Therefore, arrears for the period prior to 2020 should be calculated at the reserved rent of Kshs.5,000/- per month, and only from January 2020 should the Kshs.59,000/- rate apply.
