Procedural Posture

Environment and Land Case / Judgment

  1. 1 Whether the subdivision and transfer of Kajiado/Olooloitikoshi/Kitengela/3 and its resultant parcels were fraudulent and illegal.
  2. 2 Whether the plaintiff proved fraud or illegality in the acquisition of the suit properties by the defendants.
  3. 3 Whether the suit is statute barred under the Limitation of Actions Act.

Ratio Decidendi

The court found that the plaintiff failed to prove, on a balance of probabilities, that the subdivision and transfer of Kajiado/Olooloitikoshi/Kitengela/3 and its resultant parcels were fraudulent or illegal. The plaintiff did not provide any forensic evidence to support the claim that the thumbprint on the mutation form was forged, nor did he demonstrate that the deceased did not participate in or consent to the subdivisions. The deceased retained and further subdivided one of the resultant parcels during his lifetime without raising any complaint. The court held that the cause of action arose in 1982, and the suit, filed in 2018, was statute barred under the Limitation of Actions Act....

Court Disposition

Plaintiff's suit dismissed with costs to the defendants. Counterclaims by the 11th, 13th, and 17th defendants allowed.
