Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the dismissal of the claimant was unlawful.
  2. 2 Whether the claimant is entitled to terminal dues and compensation for unfair termination.

Ratio Decidendi

The court found that while the respondent had a valid reason to dismiss the claimant for absenting himself from duty without permission, the procedure followed was not fair as required by section 41 of the Employment Act. The claimant was not notified in advance that he was attending a disciplinary hearing, nor was he informed of his right to be accompanied by a representative. The dismissal letter did not state the reason for termination. Consequently, the court held that the termination was procedurally unfair and therefore unlawful, entitling the claimant to compensation and salary during suspension, but reduced the compensation due to the claimant's contributory misconduct.

Court Disposition

Judgment for the claimant; termination declared unfair and unlawful; monetary award granted.

Orders
