Ratio Decidendi

The Tribunal found that the Respondent failed to provide sufficient evidence to establish that the matter was res judicata, as no pleadings or case number from the alleged previous Rent Restriction Tribunal proceedings were produced. The burden of proof for res judicata rested on the Respondent, who did not discharge it. On the issue of rent arrears, the Tribunal noted the existence of a signed Settlement Agreement and a letter acknowledging arrears of Kshs. 82,500 by the Applicants, with no evidence of payment or dispute of the arrears.
