Ratio Decidendi

The court found that the Respondent failed to provide the Claimant with a written notice of termination or a proper disciplinary hearing as required by Sections 35(1)(c) and 41 of the Employment Act, 2007. Furthermore, the Respondent did not substantiate the allegations of incitement with evidence or witness testimony, thus failing to prove valid and fair reasons for termination under Sections 43 and 45. As a result, the termination was both procedurally and substantively unfair. The Claimant, having served for about 16 years, was awarded compensation equivalent to 8 months' gross wages. The court also ordered the Respondent to issue a certificate of service and pay costs to the Claimant.
