AT EMBU
CRIMINAL APPEAL 116 OF 2002

REPUBLIC...........................................................................................RESPONDENT
RULING/ORDER
The Appellant having heard the response by the State Counsel has decided to withdraw the Appeal. That is a wise move because there would have been the risk of the sentence being enhanced in view of the seriousness of the charges and the very lenient sentences imposed on him.
That being the case, the Appeal herein is marked as withdrawn.
Orders accordingly.
