The court held that, pursuant to Section 5 of the Insurance (Motor Vehicle Third Party Risks) Act, the defendant insurer's liability to satisfy a judgment in respect of a third party claim is capped at KShs.3,000,000. The plaintiffs' claim for the full decretal sum was not supported by the current law, which imposes a statutory limit on the amount recoverable from an insurer. The court found that the defendant was only obliged to pay up to the statutory maximum, and any excess could be pursued directly from the insured. The court issued a declaration to this effect and awarded the plaintiffs costs of the suit.
