Legal Issues
- 1 Whether the appellant has abandoned his appeal by failing to take further steps after filing the petition and grounds of appeal.
- 2 Whether the appeal should be considered abandoned and the file closed.
Ratio Decidendi
The court found that the appellant, having filed a petition and grounds of appeal but having taken no further steps, and having likely completed the sentence imposed, is deemed to have lost interest in the appeal. The appeal is therefore considered abandoned and the file is ordered closed. This decision is based on the principle that the court will not keep appeals alive where the appellant has shown no interest in prosecuting them, especially where the sentence has already been served.
Court Disposition
Appeal considered abandoned and file closed.
Orders
- The appeal is considered abandoned.
- The file is closed.
