Ratio Decidendi

The court found that the applicant's interest in parcel number 569 and its resultant subdivisions had already been conclusively determined by previous tribunals and courts, including the High Court, which had issued orders removing any inhibition or encumbrance. The issues raised in the current application were therefore res judicata and constituted an abuse of the court process. There was no sufficient ground to interfere with the Chief Magistrate's ruling, and the appeal was summarily dismissed under section 79B of the Civil Procedure Act.
