Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the claimant was in continuous service of the respondent from 28.04.2009 to 31.05.2015.
  2. 2 Whether the claimant's service converted from casual to regular employment under section 37 of the Employment Act, 2007.
  3. 3 Whether the fixed term contract as production clerk terminated the claimant's long service as store clerk.

Ratio Decidendi

The court found that the claimant was in continuous service from 28.04.2009, initially as a store clerk and later as a production clerk, and that his employment had converted from casual to regular under section 37 of the Employment Act, 2007. The fixed term contract did not extinguish his long-term service, and the purported termination on account of effluxion of time was not a valid reason under section 43 of the Act. The court held that the termination was unfair and that the claimant was entitled to reinstatement to his substantive position as store clerk with continuous service and full benefits, as well as back pay and costs.
