Procedural Posture
Miscellaneous Application / Ruling on Application for Judgment on Taxed Costs and Consolidation
Legal Issues
- 1 Whether the application for consolidation of multiple miscellaneous applications involving the same parties should be granted.
- 2 Whether judgment should be entered in favour of the applicant/advocate against the respondent/client in terms of the certificates of taxation.
- 3 Whether a single decree should issue for execution of the taxed costs as consolidated.
Ratio Decidendi
The court found that the respondent, having been served with the application and not having filed any reference or objection to the certificates of taxation, had no valid basis to oppose the entry of judgment. The court further held that consolidation of the 19 related miscellaneous applications was appropriate as they involved the same parties and similar issues, thereby promoting judicial efficiency. Accordingly, judgment was entered for the applicant/advocate against the respondent/client in all the listed applications in terms of the certificates of taxation, and a single decree was ordered to issue for execution of the consolidated taxed costs.
Court Disposition
application allowed; judgment entered for applicant; matters consolidated
