Procedural Posture

Originating Summons / Judgment

  1. 1 Whether the defendant and the deceased sold the suit property to the plaintiff.
  2. 2 Whether the deceased and the defendant signed the indenture of conveyance dated 10th July 1996.
  3. 3 Whether the plaintiff is entitled to the reliefs sought in the originating summons.

Ratio Decidendi

The court found that the plaintiff failed to produce any sale agreement or credible evidence of payment for the suit property. The indenture of assignment, which purportedly evidenced the sale, was found by an expert document examiner to be a forgery, and this expert evidence was unchallenged. The court concluded that there was no sale of the property to the plaintiff and that the plaintiff's actions appeared to be an attempt to fraudulently acquire the property after the deaths of the advocate and the deceased. Consequently, the plaintiff was not entitled to any of the reliefs sought, and the suit was dismissed with costs to the defendant.
