The court found that the Land Disputes Tribunal convened by the District Commissioner lacked jurisdiction to determine the issue of ownership of land, as such matters fall outside the scope of Section 3(1) of the Land Disputes Tribunal Act, 1990. The Tribunal's proceedings and award were therefore ultra vires and null and void. Furthermore, the Tribunal was not properly constituted, as there was no formal claim lodged or registered, and the panel of elders was not gazetted as required by law. Consequently, the decree issued by the Iten Resident Magistrate's Court, which adopted the Tribunal's award, was also a nullity and incapable of execution.
