The special damages were properly pleaded and proved. The court therefore set aside the trial court's award of Kshs. 800,000 and substituted it with Kshs. 450,000, maintaining the special damages at Kshs. 83,356, and applying the agreed liability apportionment of 70:30 in favour of the respondent.
