Ratio Decidendi

The court held that following the High Court's declaration that the Contempt of Court Act was unconstitutional and invalid, the statute was removed from the statute books in line with the doctrine of eclipse. As a result, the applicant's motion for contempt, which was premised on the now-invalid statute, could not be sustained. The court therefore struck out the application, finding that there was no longer any legal basis for the relief sought. No order as to costs was made, as the legal foundation for the application had ceased to exist due to the declaration of unconstitutionality.
