The court found that the claimant was summarily dismissed by the respondent, as evidenced by documentary proof and admissions by the respondent's witnesses. The respondent failed to justify the summary dismissal or provide a valid reason, and did not follow fair procedure as required by law. The dismissal was therefore wrongful and unfair under sections 41 and 45 of the Employment Act, 2007. The claimant was entitled to compensation for unfair dismissal and payment in lieu of notice, but not for untaken leave, as he had already been paid in lieu of leave. The court awarded the claimant six months' salary as compensation and one month's salary in lieu of notice, with interest and costs.
