The respondent failed to prove the alleged economic crisis or financial constraints justifying redundancy, and did not follow the mandatory redundancy procedure under section 40 of the Employment Act, including giving prior notice to the claimants and paying terminal dues before termination. The claimants were not selected through a fair process, and the respondent did not provide evidence of financial hardship. The termination was therefore both substantively and procedurally unfair.
