Ratio Decidendi

The court held that it lacked jurisdiction to grant a stay of execution because the Respondent had already moved to the Court of Appeal for extension of time to file an appeal, and the Court of Appeal was seized of the matter. Once the higher court is seized of a matter, the lower court becomes functus officio and cannot grant the orders sought unless the matter is remitted back. Furthermore, the Respondent had not demonstrated sufficient grounds for stay, as there was no valid appeal pending and no evidence of substantial loss. The application was therefore dismissed for want of merit.
